1. Concepts

1.1

Operator of the eHotel.cz Portal - eHotel.cz, s.r.o. company with registered office at Lomnického 1742/2a, 140 00 Prague 4, IČO 24285536, VAT number: CZ24285536, telephone 777 056 441 email: info@ehotel.cz

1.2

Client – a person (natural or legal entity) ordering services offered by the eHotel.cz Portal in Accommodation Facilities.

1.3

Accommodation facility – the owner/tenant of accommodation premises, providing accommodation services to the Client according to the order mediated by the Operator.

2. Introductory Provisions

2.1

These General Terms and Conditions (hereinafter referred to as the "GTC") govern the contractual relations between the eHotel.cz Portal, the Client and the Accommodation Facility in the implementation of accommodation reservation mediation, offered by the Accommodation Facility on the eHotel.cz Portal website or other websites.

2.2

2.3

The client always accepts the entered General Terms and Conditions by creating a reservation, Booking Record or ordering services via the eHotel.cz Portal.

3. Services

3.1

The Client is entitled to use the Services of the eHotel.cz Portal only in good faith for the purpose of entering a request for an offer or booking accommodation that is in accordance with legal regulations, and by using the Services, he undertakes not to make speculative, false or misleading bookings and not to book accommodation capacity beyond its actual requirement. By using the Services, the Client declares that he is the holder of benefit points and that his personal and contact information entered during the reservation and the information provided for payment purposes (e.g. payment card information) are correct. By using the Services, the Client acknowledges that the eHotel.cz Portal may use this information in accordance with the provisions of the Information Memorandum on the Processing of Personal Data to contact the Client if necessary. The responsibility for any damage caused by the inaccuracy of the entered data is borne by the Client. The Client acknowledges and, by using the Services, expresses his/her consent to the fact that the eHotel.cz Portal is authorized to release his/her personal and contact information entered during the reservation, as well as information about his/her previous, ongoing or future reservations, based on the relevant request, to a public administration body or the police.

3.2

Portal eHotel.cz reserves the right, at its own discretion, to permanently or temporarily exclude some Clients from the possibility of using the services available through the Website (i.e. to place Users on the so-called black list). A blacklisted Client may not attempt to use the Website under another name or through another Client.

4. The process of ordering services and their payment

4.1.

The client expresses his interest in the service by entering and sending the form. The eHotel.cz portal will verify the free capacity of the Accommodation Facility on the date requested by the Client and will provide the Client with information (Reservation Confirmation) about the availability and specific price of accommodation for the selected date. The binding ordering of the service occurs at the moment of the written Confirmation of the reservation through the eHotel.cz Portal, i.e. by sending the Confirmation of the reservation to the Client's email address.

4.2.

The price of the service is determined by the Accommodation Facility. The eHotel.cz portal increases the price of the service by a handling fee for the transfer of benefit points, bank transactions and levies of 18% of the accommodation price. The price depends on the selected date, the number of people and other parameters entered by the Customer when entering the reservation. The eHotel.cz portal informs the Customer of the final price in the Reservation Confirmation, which will result in a binding order for services.

4.3.

Payment is made by transferring benefit points in favor of Portal eHotel.cz in the amount of 100% of the price of the stay. For reservations that are already subject to cancellation conditions according to the Accommodation Facility OP, the Accommodation Facility and the eHotel.cz Portal require a payment card guarantee in the amount of 100% of the stay price. The Client is informed about the payment card guarantee during the reservation confirmation process - cancellation. No amount will be deducted from the client, the card is only used to guarantee the client's binding reservation and will only be used if the client does not pay benefit points equal to the amount of the accommodation or does not pay the reservation supplement and if a situation arises where Portal eHotel.cz is entitled to charge a cancellation fee . The client is obliged to enter true and complete information about his payment card. In the event that the authorization is rejected by the bank without giving a reason or due to an unsecured account, the payment of cancellation fees for the reservation will be enforced, including the right to interest on late payment. We inform the Client about this within 72 hours by email.

4.4.

The total price of the reservation is paid with benefit points using the integrated online payment gateway of a specific benefit company. If the Client does not have a sufficient amount of benefit points, it is possible to pay the surcharge by payment card (the client will receive a generated link to the specific amount of the surcharge) or by cashless transfer to the account (based on the document that the Client receives).

4.5.

The accommodation facility hereby agrees to mediate communication by the eHotel.cz Portal about the use of the Accommodation Mediation service, which is provided to it or is provided on its behalf.

4.6.

The reservation is made by filling in and sending the form located on the Website of the Portal eHotel.cz, thereby ordering the accommodation reservation directly with the Partner - the Accommodation Facility that operates the accommodation. According to the method of entering the reservation, the eHotel.cz website system distinguishes between two types of Partners:

4.6.1

In the case of an accommodation reservation with the Partner - "Request only", which guarantees confirmation of the reservation within 1 working day, the Client will receive confirmation of a successful reservation, or within 1 working day, the Client will receive a message about the failure of the reservation. By sending the reservation, the Client acknowledges that if the Partner confirms the reservation, a contract (binding reservation) is created between the Client and the Partner, from which the Client is entitled to withdraw only under the conditions set by the Partner (OP) and published on the given Reservation Confirmation under the point "Cancellation conditions" or the website of the Accommodation Facility.

4.6.2

If the reservation refers to accommodation with a Partner - "Online Reservation", which guarantees immediate confirmation of the reservation, and if it does not contain any notes, the Client will receive a confirmation of a successful reservation to the specified e-mail address immediately after sending the reservation. By sending the reservation, the Client acknowledges that a contract (binding reservation) is created between him and the Partner, from which the Customer is entitled to withdraw only under the conditions set by the Partner and published on the given Reservation Confirmation under the point "Cancellation conditions" or on the website of the Accommodation Facility.

4.6.3

If the Client makes a note in the reservation that may affect the price of the reservation or may jeopardize the reservation of accommodation as a whole, eHotel.cz may deem it necessary to discuss the reservation with the Partner. In this case, the rules for confirmation within 1 working day apply to the reservation (see above).

4.7.

Buying a reservation on the Booking.com portal

4.7.1

In the event that the Client creates a Record of accommodation via the Booking(.com) portal and within the next 4 days the price of said accommodation on the Booking(.com) portal is increased, the Operator has the option of contacting the Client to match the price increase.

4.7.2

By creating an accommodation reservation via the Booking(.com) portal, the client agrees to the terms and conditions of the accommodation requested from the company ehotel.cz and wants to make the reservation on the Booking(.com) portal. ehotel.cz does not guarantee the conditions of the accommodation facility (such as stays with a pet, deposits for possible damages, check-in and check-out conditions, etc.), it is necessary to have the conditions of the stay verified in advance with the accommodation facility. By creating a binding reservation on Booking.com, ehotel.cz agrees to these conditions based on this consent of the client.

4.7.3

Portal eHotel.cz, s.r.o. does not accept discounts and benefits of the Client, which the Client has on his account on the Booking(.com) portal. Portal eHotel.cz, s.r.o. accepts a request for a reservation on the Booking(.com) portal from the Client with the price and conditions of accommodation set on the Booking(.com) portal as shown in the case of a non-logged-in user of the Booking(.com) portal and searched in the mode of the Affiliate Program of the Booking(.com) portal ). Portal eHotel.cz, s.r.o. however, he can purchase the accommodation under any conditions, including discounts and bonuses resulting from his own account on Booking(.com).

4.7.4

The Client may not change the information in the reservation on the booking portal Booking(.com), which he had created through eHotel.cz, s.r.o.. Namely the contact email, date of arrival or departure, or cancel the reservation. If the Client would like to make any changes to the reservation on the Booking(.com) reservation portal, he will first notify eHotel.cz, s.r.o.. If he has already made the change, he will immediately inform eHotel.cz, s.r.o. by means of email or telephone communication. Violation of this condition is subject to a fine to the Client in the amount of costs incurred in changing the reservation by Portal eHotel.cz, s.r.o..

4.7.5

A Client who is in arrears with the booking portal Booking.com or whose account has been blocked at the booking portal Booking.com for any reason may not submit a booking request on the booking portal Booking(.com) through eHotel.cz, s.r.o. under a fine of CZK 50,000.

4.8.

Payment of the invoice for accommodation provided by the client

4.8.1

In the case of payment for a foreign accommodation reservation, the payment will be made in the relevant currency by the eHotel.cz Portal to the bank account specified in the international format (IBAN) incl. SWIFT/BIC guaranteed by the accommodation provider, i.e. which will be indicated in the entered Invoice / tax document in printed or electronic form.

4.8.2

In the event of a refund of the payment made - rejection by a foreign bank, eHotel.cz does not guarantee a refund of the entire amount. The amount may be reduced by the bank by the applicable charges (SHA). The client is entitled to a refund of the funds spent up to the amount of the actual returned value to the account of Portal eHotel.cz.

4.9.

Kiwi Voucher

4.9.1

For the purposes of these terms, an Electronic Voucher means a specific promo code issued by Kiwi.com s.r.o., with its registered office at Lazaretní 925/9, 615 00 Brno (hereinafter referred to as the „Issuer“) for eHotel.cz, s.r.o., with its registered office at Lomnického 1742/2a, 140 00 Prague 4, as a distributor distributing these Electronic Vouchers (hereinafter referred to as the „Distributor“) to users of its services authorized to purchase them under the applicable law and in accordance with the terms and conditions of the ehotel.cz portal (hereinafter referred to as the „User“)

4.9.2

The Electronic Voucher is always issued for a specific nominal value expressed in Czech crowns (CZK), depending on the User’s choice, while the User is entitled to use it for single payment for the Issuer’s services – brokerage of passenger carriage and related services – as an alternative payment method supported (according to current availability) within the reservation system on the website www.kiwi.com or in the relevant mobile applications of the Issuer after clicking on the „Využít promokód“ button, up to the nominal value of the Electronic Voucher, but always in accordance with these terms.

4.9.3

The Electronic Voucher is valid for the period specified in the Electronic Voucher, otherwise, if this period is not specified, for a period of one year as of its issuance by the Issuer in favor of the Distributor. The current validity period will be communicated to the User according to the conditions of the portal provide otherwise, on request. The validity period of the Electronic Voucher cannot be extended and after this period the User loses the right to use the Electronic Voucher in accordance with these terms, without the right to any compensation or refund.

4.9.4

An Electronic Voucher shall not be exchanged for cash or other assets, except from its use in accordance with these terms. The value of the Electronic Voucher shall not be repaid to the User, even after the expiry of the Electronic Voucher.

4.9.5

If the User has selected a payment in a currency other than Czech crowns (CZK) within the Issuer’s reservation system and wants to use an Electronic Voucher for payment in this other currency, the value of the Electronic Voucher will be converted to this currency using the current conversion rate normally used by the Issuer for this purpose within its reservation system.

4.9.6

Each Electronic Voucher can be used to pay for single reservation in the Issuer’s reservation system. If the value of the reservation is higher than the nominal value of the Electronic Voucher, the User is obliged to pay the difference with another of the supported electronic payment methods; if the value of the reservation is lower than the nominal value of the Electronic Voucher, the difference is not returned or reimbursed to the User, and it is not usable for further reservation of the User; therefore, the unused difference is forfeited without compensation.

4.9.7

Only one Electronic Voucher can be used for each reservation in the Issuer’s reservation system.

4.9.8

The Electronic Voucher can be used to reserve the services of the Issuer, and thus for the purpose of brokering personal transport, only for the benefit of the User and / or her/his family member (not for other third parties), always and only in connection with the purchase / reservation / order of another performance related to personal recreation (e. g. accommodation) provided by a third party and intermediated via the portal eHotel.cz. The Electronic Voucher cannot be transferred to a third party.

4.9.9

Any reimbursement of the price of transportation or services of the Issuer and other claims related to the services of the Issuer provided to the User who paid the reservation price via the Electronic Voucher are governed by the general Terms and Conditions of the Issuer, which the User became acquainted with and which User agreed upon within the reservation process in the Issuer’s reservation system. The User acknowledge that any such reimbursement may be, in accordance with the general Terms and Conditions of the Issuer, provided in the form corresponding to the form of the original payment, i.e. also in the form of the Electronic voucher or other credit usable for the payment for the Issuer’s services.

4.9.10

The Issuer reserves the right to cancel any valid Electronic Vouchers issued to the User and / or refuse to provide further services or cancel services already provided to the User in the event that the User has violated these terms or the Issuer’s general Terms and Conditions applicable to the User in connection with individual reservations paid for by the Electronic Voucher.

4.9.11

Any questions and complaints related to the purchase of an Electronic Voucher through the eHotel.cz portal, information provided on the eHotel.cz portal or in connection with the Distributor’s services must be addressed to the Distributor as the operator of the said portal in accordance with the terms of use of the eHotel.cz portal.

4.9.12

The client undertakes to use the Kiwi voucher for the purchase of an airline ticket in conjunction with the use of an eHotel.cz voucher for accommodation within one application of their employee benefit points

5. Cancellation terms and complaints

5.1.

The cancellation conditions are determined by the Accommodation in OP. In the event that the Accommodation Facility does not have its own cancellation conditions defined, the General Terms and Conditions of the Portal eHotel.cz are valid. Based on the payment card guarantee, a cancellation fee is charged when a reservation is canceled with a cancellation fee or a no-show. If the reservation is canceled (the cancellation of the reservation is considered a written confirmation sent by e-mail to Portal eHotel.cz about the cancellation of the reservation), the OP of the Accommodation Facility or GTC of Portal eHotel.cz apply. For the payment of the cancellation fee, Portal eHotel.cz is entitled to offset the 100% advance payment already paid by the Customer or to use the payment card guarantee and the Client's payment card details to pay the cancellation fee

5.2.

The client is obliged to inform Portal eHotel.cz of all changes in the reservation or its cancellation in writing (email: info@ehotel.cz) as soon as possible as soon as the change has occurred.

5.3.

Complaints about the quality of accommodation in the Accommodation Facility and the services provided by the Accommodation Facility are made directly at the Accommodation Facility.

5.4.

Complaints about eHotel.cz Portal services are possible in writing electronically to the email address info@ehotel.cz or by correspondence to eHotel.cz, s.r.o. Lomnického 1742/2a (Chenen), 140 00 Prague 4

5.5.

In the event of a conflict between the cancellation conditions in the General Terms and Conditions and in the OP, the cancellation conditions of the Accommodation facility take priority.

5.6.

In the event that the client uses paper vouchers from the benefit company SODEXO or UP Group in the reservation and the reservation is cancelled, we do not return these vouchers by default, but save the value of the vouchers on a voucher valid for 1 year. Should the client require the original paper vouchers to be returned to the sending address, it is necessary to expect a time delay and an administrative fee of CZK 200. This can only be done if the original paper vouchers have not yet been handed over and settled with the benefit company.

6. Personal data

6.1.

The operator of the eHotel.cz portal, the company eHotel.cz, s.r.o., with registered office at Lomického 1742/2a (Chenen), 140 00 Prague 4, ID number 24285536, company registered at the Municipal Court in Prague, section C, file 193227, is authorized in accordance with relevant generally applicable legal regulations, in particular in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons in connection with the processing of personal data and on the free movement of such data and on the repeal of Directive 95/46/EC (hereinafter referred to as "GDPR") and Act No. 480/2004 Coll., on certain information society services, to process and store information and data provided to him for the purpose of mediating the order (hereinafter referred to as "Personal Data"), especially for the purpose of mediating services. The eHotel.cz portal is the administrator of all Personal Data it processes. Personal data will not be provided to any third party except for the Accommodation Facility and companies financially connected to the eHotel.cz Portal. Each party is required to provide adequate protection of Personal Data to prevent its loss, unauthorized access, use, deletion and disclosure, and in accordance with applicable laws, to process Personal Data in a manner that ensures adequate confidentiality and security of Personal Data. Data obtained in accordance with the law will be processed for the period imposed by law, other data for a maximum period of 2 years from the Customer's last order. Personal data is processed for the purpose of providing the ordered service correctly and for the purpose of more accurately offering suitable additional services.

6.2.

The eHotel.cz portal uses cookies and processes Personal Data in the manner described in the separate Privacy Statement document on the page https://www.ehotel.cz/obchodni-podminky . We use "Secure Socket Layer (SSL)" technology when providing our services in order to protect and keep your payment card information confidential.

6.3.

Commercial communications offering similar or related services may be sent to the customer from the portals operated by eHotel.cz to the e-mail address or phone number, unless the customer expresses his disagreement. The Customer can express disagreement with the processing of Personal Data at the email address sales@ehotel.cz. Personal data obtained for sending special offers are kept until they are revoked at /about/unsubscribe or by contacting sales@ehotel.cz. The e-mail address will be processed for a period of 5 years from the order of services via the eHotel.cz portal.

6.4.

Telephone calls to the eHotel.cz Portal's Customer Line are recorded for the reasons listed below. The client is informed before starting the call.

6.4.1

In the event that a service is ordered via a telephone call, Portal eHotel.cz records this call for the purpose of certifying that there has been an expression of agreement with the terms and conditions and thus also the conclusion of a contractual relationship.

6.4.2

The eHotel.cz portal also records telephone calls for the purpose of improving the quality of services and proving customer claims related, for example, to the application of modifications or changes to reservations.

6.4.3

Such recording and thus processing of personal data is possible due to the legitimate interest of the operator. You have the opportunity to object to such processing to the operator, either directly within the framework of a telephone call or additionally to the operator"s contact e-mail address: sales@ehotel.cz

6.4.4

The operator stores telephone calls for as long as necessary,

In the case of verification of the conclusion of a contractual relationship for a period of 5 years,
